Terms of Service

1. Introduction
These Terms of Service (hereinafter "Terms") govern the use of the Trace4 platform (hereinafter "Service"), provided by Hubgen (hereinafter "Provider"), based in Italy. Use of the Service implies full acceptance of these Terms.
2. Description of the Service
Trace4 is a SaaS platform for creating and managing Digital Product Passports (DPP) compliant with EU Regulation ESPR 2024/1781. The Service allows you to create digital passports, generate QR codes, manage product data, and verify regulatory compliance.
3. Registration and account
To use the Service, you must create an account providing accurate and complete information. You are responsible for the confidentiality of your credentials and all activities performed through your account.
4. Plans and payments
The Service is available in several pricing plans, details of which are published on the pricing page. Payment is made on a monthly or annual basis, depending on the plan chosen. Prices may be updated with at least 30 days' notice.
5. User obligations
The user agrees to:
- Provide truthful and up-to-date information.
- Use the Service in compliance with applicable law.
- Not use the Service for unlawful or unauthorised purposes.
- Not attempt to access unauthorised systems or data.
- Not interfere with the operation of the Service.
6. Intellectual property
All intellectual property rights relating to the Service, including software, design, trademarks, and content, are the exclusive property of the Provider. The user retains ownership of the data entered into the platform.
7. Service availability
The Provider endeavours to ensure maximum availability of the Service but cannot guarantee uninterrupted operation. Scheduled maintenance will be communicated with reasonable notice.
8. Limitation of liability
The Service is provided "as is". The Provider shall not be liable for indirect, incidental, or consequential damages arising from use of the Service. The Provider's maximum liability is limited to the amount paid by the user in the 12 months preceding the event.
9. Regulatory compliance
Trace4 supports companies in achieving compliance with ESPR Regulation 2024/1781. However, ultimate responsibility for product compliance remains with the user. The Provider does not provide legal advice.
10. Data protection
Personal data is processed in accordance with GDPR (Regulation (EU) 2016/679). For more information, please see our Privacy Policy.
11. Withdrawal and termination
The user may withdraw from the Service at any time, effective from the end of the current billing period. The Provider reserves the right to suspend or terminate the user's account in the event of a breach of these Terms.
12. Governing law and jurisdiction
These Terms are governed by Italian law. Any dispute shall be subject to the exclusive jurisdiction of the courts of the Provider's registered office.
13. Changes to Terms
The Provider reserves the right to modify these Terms at any time. Changes will be communicated via the website and/or email with at least 15 days' notice. Continued use of the Service after modification constitutes acceptance of the new Terms.
